
Section 1. Definitions 1.1 Likeness. “Likeness” means any image, photograph, video, audio recording, voice sample, biometric data, or other identifiable representation of a person. 1.2 Recording device. “Recording device” means any device or technology capable of capturing audio or visual data, including phones, tablets, cameras, wearables, and similar tools.
Section 2. Consent Requirement 2.1 No person, corporation, or entity shall use an individual’s likeness for advertising, commercial promotion, or artificial‑intelligence training or applications without the individual’s prior, informed, and express consent.
Section 3. Prohibition on Unauthorized Storage and Transfer 3.1 No person or entity shall store, retain, transfer, sell, or otherwise place another person’s likeness in any personal, corporate, or third‑party database for sale, targeted advertising, profiling, or technological processing without explicit consent.
Section 4. Recording Restrictions 4.1 No person shall record, photograph, or otherwise capture the likeness of another person with any recording device without that person’s prior consent. 4.2 Approaching a person and initiating recording without consent is prohibited.
5.1 If consent is not granted, any image, video, or audio containing an identifiable person must be blurred, redacted, anonymized, or otherwise altered to prevent identification before posting, publishing, broadcasting, or distributing to any mainstream media outlet or any social‑media platform. 5.2 It is prohibited to use artificial‑intelligence tools to generate, modify, or promote a look‑alike image, voice, or likeness of an identifiable person for the purpose of creating, influencing, or suggesting a narrative of innocence or guilt in any criminal investigation.
Section 6. Civil Remedies and Enforcement 6.1 A person whose likeness is used, recorded, stored, or distributed without consent shall have a private right of action and may seek monetary damages, injunctive relief, and any other remedies provided by law. 6.2 Remedies shall be available against individuals and entities, including corporations and third‑party data processors.
Section 7. Public‑Interest Exceptions 7.1 Sections 2–5 do not apply when recording or use of likeness is undertaken in good faith for: (a) documenting criminal activity or evidence; (b) preserving evidence that may exonerate an individual; (c) exposing corruption, financial misconduct, obstruction, or intimidation by local, state, federal, or bureaucratic government actors, whether public or private; (d) public‑safety operations, including Amber Alerts, manhunts, or efforts to locate or protect victims of crime. 7.2 Recordings made under this Section must be used only for the stated public‑interest purpose and handled in a manner that minimizes unnecessary disclosure.
Section 8. Scope and Applicability 8.1 The protections of this statute apply to all persons, including minors and public figures, and govern interactions between citizens and between citizens and institutions.
